By downloading or otherwise accessing film, photo, or logo files (“press material”) provided in the press media library, you agree to the following Terms of Use and License Conditions (“Terms of Use”) as amended. Please read these carefully before using the press material.
1. Copyright and other property rights
All content in the press media library is subject to copyright, trademark, design, or other industrial property rights. Unless expressly stated otherwise, all rights to this content are held exclusively by Talanx AG (“Talanx”). Any use not expressly granted is prohibited.
2. Scope of the license
Talanx grants you a free, non-exclusive, non-transferable, non-sublicensable, and at any time revocable license to publish, reproduce, and make publicly available the press material exclusively for journalistic and editorial purposes in the context of reporting on the companies of the Talanx Group. Use for advertising, commercial, or other non-editorial purposes is prohibited. Changes, edits, or other alterations to the press material – including enlargements of sections, collages, cross-fades, animations, or color changes – are only permitted if they are absolutely necessary to comply with technical specifications and do not distort the content or message. Any distortion within the meaning of Section 14 of the German Copyright Act (UrhG) is always prohibited.
3. Prohibition of sublicensing and registration of property rights
You are not entitled to grant third parties sublicenses to the press material, to resell the press material or to exploit it commercially in any other way. Furthermore, you undertake not to apply for or register trademark, design, or other industrial property rights to or in relation to the press material, trademarks, or logos of Talanx, either for yourself or for third parties.
4. Source and copyright information
Whenever the press material is used, “Talanx AG” must be clearly indicated as the source and, if specified in the accompanying text, the respective named author must be clearly indicated in the immediate vicinity of the material used.
5. Specimen copy / proof of use
If you use the press material in print or online media, a specimen copy (print) or a reference with a link (online) shall be provided to Talanx at the email address gc@talanx.com immediately after publication and without Talanx having to request this.
6. Prohibition of misuse and revocation
Any misuse, illegal use, or use of the press material not expressly permitted in these Terms of Use will result in the automatic termination of the license granted. Talanx reserves the right to stop providing the press material, prohibit further use, and take legal action against those responsible if such use is suspected.
7. Disclaimer
The press material is provided to the best of our knowledge. Nevertheless, Talanx does not guarantee that the press material is free of third-party rights, complete, correct, or up to date. Talanx shall not be liable for slight negligence unless a breach of cardinal contractual obligations is involved; in this case, liability shall be limited to foreseeable damage typical for this type of contract. The limitations of liability do not apply in the event of injury to life, limb, or health, or in the event of claims under the Product Liability Act.
8. Indemnification
You indemnify Talanx against all third-party claims resulting from your contractual or unlawful use of the press material and shall bear all reasonable costs incurred by Talanx for legal defense in this connection.
9. Data protection
When using the press media library, personal data will be processed exclusively in accordance with the Talanx privacy policy. By using the press media library, you confirm that you have read and understood the privacy policy.
10. Changes to the Terms of Use
Talanx reserves the right to change these Terms of Use at any time with future effect. The version available on the website at the time of use shall be authoritative.
11. Applicable law and place of jurisdiction
German law shall apply, excluding the UN Convention on Contracts for the International Sale of Goods. The exclusive place of jurisdiction for all disputes arising from or in connection with these Terms of Use is Hannover, provided that the user is a merchant, a legal entity under public law or a special fund under public law.
12. Severability clause
Should any provision of these Terms of Use be or become invalid in whole or in part, the validity of the remaining provisions shall remain unaffected. In place of the invalid provision, a valid provision shall be deemed to have been agreed that most closely approximates the economic purpose of the invalid provision. The same applies to any loopholes in the provisions.
